Do you need Council consent to remove a tree in Auckland?


Good news for most homeowners, since general tree protection was removed from the Resource Management Act, there's usually no city-wide consent needed to remove an ordinary tree on your own private property in Auckland. But some trees are still protected and the fines for getting it wrong are steep, so it pays to check before you chop.

You'll likely need resource consent if the tree is:

  • Listed as a Notable/Scheduled tree (Schedule 10 of the Auckland Unitary Plan)

  • In a Significant Ecological Area (SEA)

  • In a riparian or coastal margin — near a stream, wetland or the coast

  • In a heritage overlay or historic character area

  • On Council or public land, including street trees

  • Protected by a covenant, consent notice or an earlier resource consent on the property
